In addition, when this offense is accompanied by any sexual act, a sentence of 1 to 3 years imprisonment shall be imposed, which may increase if the offense is committed against persons belonging to a vulnerable group.
On the other hand, it adds a Chapter IV to Title X, "Procedure for Crimes against Sexual Harassment in Public Spaces", of the National Code of Criminal Procedures, to establish the stages and steps within which they must be followed to prove the commission of the crime. It establishes that the procedure will begin with the presentation of the probable offender by any public security officer before the corresponding Public Prosecutor's Office, either at the request of the offended person or at the express request of the person or persons who have witnessed the commission of the crime.
Likewise, it proposes that the proceedings be dismissed orally and publicly in a single hearing within a period of no more than eight hours after the presentation of the probable offender.
Reforms articles 5, 13, 15, 17, 36, 39 and 44 of the General Law on Women's Access to a Life Free of Violence to introduce the figure of the Citizen Observatory as an advisory body charged with assessing, influencing and proposing legislative measures And public policy aimed at preventing and eradicating any type of violence against women in public spaces.
